The Argentine Naval Prefecture approved a new ordinance establishing rules and forms for procedures related to the National Ship Registry, with the aim of simplifying and streamlining administrative procedures, strengthening digital management, and facilitating service to vessel owners and users.
Ordinance N.º 1-26 (DPSN), Volume 2 “Administrative Regime of the Vessel,” stipulates that procedures before the National Ship Registry are to be carried out primarily through the Distance Procedures (TAD) platform, while maintaining the possibility of conducting certain procedures in person in duly justified cases.
Among the main modifications, the automatic prohibition to navigate due to non-payment of the Annual Fixed Fee for Registration Renewal is eliminated. Thus, the existence of a debt for this concept will not prevent the entry or processing of the corresponding files.
Likewise, for certain new vessels and naval artifacts, an owner's sworn declaration is incorporated, through which it is certified that the unit is in adequate seaworthy conditions and that the person operating it has the corresponding enabling documentation.
The new regulations also expand the possibilities for intervention by professionals registered with the Professional Council of Naval Engineering and by Recognized Organizations within the simplified regime.
Regarding outboard motors, registration is made mandatory for those of 85 kW or more, while for those of lower power, registration will be optional.
In turn, for certain minor vessels, a prior Verification of Characteristics Act is established, aimed at verifying the existence of the vessel and the correspondence between its characteristics and the registered data.
On the other hand, owners of vessels with a gross tonnage equal to 2, currently included in certain groupings of the National Registry and the Special Yacht Registry, will have a period of two years from the entry into force of the Ordinance to carry out the corresponding re-registration in the Jurisdictional Registries.
The update also includes the reorganization and updating of forms corresponding to registrations, transfers, engine changes, modifications, and other registry acts, with the purpose of providing clearer and more efficient management.
The new regulations replace Ordinance N.º 9-02 (DPSN) and will come into effect upon the publication of the corresponding administrative act in the Official Gazette of the Argentine Republic.
