The Ministry of Production (Produce) has approved temporary regulations for the application of an exceptional regime related to the payment of administrative fines in the Fishing and Aquaculture subsectors.
Through Supreme Decree No. 013-2026-PRODUCE, published today in the official gazette El Peruano, this measure was established for the payment of fines imposed by Produce and the National Authority for Fisheries and Aquaculture Health and Safety ( Sanipes), within the scope of their competencies.
The regulation establishes provisions for the deferment or installment payment of these debts, including those that are in the coercive collection stage or that have an active installment payment benefit.
This exceptional regime is temporary and applicable to natural or legal persons who have administrative fine sanctions in the Fishing and Aquaculture subsectors, and who are in any of the following situations:
Outstanding fines.
Fines within the appeal period.
Fines appealed through administrative or judicial channels.
Fines in coercive collection, even if they are undergoing judicial review, except in cases where there is an effective retention communication from the withholding agent.
Outstanding balance of fractionalized fines, which are in process, under Article 42 of the Regulations for the Inspection and Sanction of Fishing and Aquaculture Activities.
Fines issued as a result of administrative sanctioning procedures that are in process during the validity period of this supreme decree and that are related to infractions in the Fishing and Aquaculture subsectors.
The deadline to avail oneself of this exceptional regime for the payment of administrative fines is valid during the declared state of emergency for the Fishing and Aquaculture subsectors established by Supreme Decree No. 012-2026-PRODUCE.
Availing oneself of the exceptional regime does not generate the right to a new discount for fines that have previously been subject to reduction or any other reduction benefit provided for in fishing and aquaculture regulations, nor does it allow for the accumulation of reduction benefits provided for in other exceptional regimes.
Natural or legal persons who avail themselves of the exceptional regime for the payment of administrative fines in the Fishing and Aquaculture subsectors pay 50% or 60%, as the case may be, of the total debt value.
The regulation states that, as a result of the application of the exceptional regime, the outstanding balance to be paid, called the reduced total debt, includes the fine, interest, costs, and expenses generated in the sanctioning and coercive collection procedure.
