The Comptroller General of the Republic of Costa Rica resolved two appeals filed against the award act of Major Tender 2024-LY-CAL-000001-Incop, corresponding to the public works concession with public service for the modernization of the infrastructure and equipment of Puerto Caldera, a process promoted by the Costa Rican Pacific Ports Institute and awarded to the Sunset Consortium (APM Terminals/Hanseatic Global Terminals).
According to the oversight body, both appeals received were submitted by the company International Container Terminal Services, Inc. (Ictsi) and were based on the alleged improper disqualification of its offer and the supposed lack of technical suitability of the proposal awarded to the Sunset Consortium.
In response, the CGR confirmed that the administration (Incop) was correct in excluding said offer, given that the appealing company's financial indebtedness level exceeds the maximum limit allowed by the tender rules.
Thus, given its inability to win the tender, the Costa Rican Comptroller's Office determined that there was no merit to rule on the remaining arguments, and therefore, the appeal was rejected.
Following this action by the Comptroller's Office, Incop is now responsible for signing the contract with the Sunset Consortium.
"We received with great satisfaction the resolution issued by the Comptroller General of the Republic, which confirms the legality of the bidding process for the modernization of Puerto Caldera," detailed Wagner Alberto Quesada Céspedes, executive president of Incop.
The international public tender was structured with the accompaniment of the International Finance Corporation (IFC), a member of the World Bank Group, which supported Incop in the design and execution of the selection process for the concessionaire responsible for financing, designing, building, operating, and maintaining Puerto Caldera, under the highest international standards of transparency, technical rigor, and competition.
The modernization of Puerto Caldera, Incop described, represents one of the most relevant infrastructure projects for Costa Rica, considering an investment of more than 600 million dollars.
