Brasília, 10/29/2026 – The National Waterway Transportation Agency (ANTAQ) approved new rules to strengthen the governance of decision-making processes and improve the procedures for analyzing and judging administrative processes. The changes were approved at the 621st Ordinary Meeting of the Collegiate Board, held on October 22nd, and published on Monday (26th) in the Official Gazette of the Union (DOU), through ANTAQ Resolution No. 142/2026.
The update to Resolution No. 66/2022 seeks to provide greater predictability and legal certainty to the Agency's internal procedures, with a clearer definition of the procedural instruction stages and the responsibilities of each area. The measures also reinforce the need for justification of administrative decisions, increasing transparency and the possibilities of social control over ANTAQ's actions.
The normative review went through Public Consultation No. 05/2026, which received 17 contributions, and involved the participation of different areas of the Agency, in addition to analyses by the Federal Attorney's Office alongside ANTAQ (PFA) and Internal Audit. The audit's action was preventive and consultative, allowing the identification of risks and opportunities for improvement before the final deliberation of the Collegiate Board.
Among the main advances are the improvement of the procedural instruction stages, the establishment of deadlines for deliberation, and the expansion of process monitoring by the Collegiate Board. The norm also establishes clearer criteria for the exceptional distribution of rapporteurships, requiring specific justification for these decisions and reasons for any extensions of deadlines.
Under the new rules, rapporteurs must preferably present processes for deliberation within 60 calendar days after receiving the records, once the technical instruction is completed. Cases exceeding 90 days of analysis must be presented by the Director-General to the Collegiate Board, allowing for greater monitoring of deadlines and the identification of possible obstacles in processing.
The resolution also allows the rapporteur to propose the participation of third parties in oral arguments, even if they are not part of the process, to contribute to the analysis of the matters and the evaluation of the possible effects of the decisions.
The changes come into effect 60 days after the publication of ANTAQ Resolution No. 142/2026 in the Official Gazette of the Union.
