Brasília, 10/23/2026 – The National Waterway Transportation Agency (ANTAQ) approved, last Thursday (22), during the 621st Ordinary Board Meeting (ROD), the Preliminary Regulatory Impact Analysis (AIR) Report addressing the review of parameters applicable to the characterization, organization, and charging of port services at container terminals. The decision authorizes the opening of Public Consultation No. 06/2026, which will receive contributions from sector agents and other interested parties between November 3 and December 2.
This initiative is part of Theme 3.10 of the 2025–2028 Regulatory Agenda and seeks to improve clarity and transparency in the provision and charging of port services, in addition to preventing potential abusive practices. Among the points analyzed is the charging of the Segregation and Delivery Service (SSE), a topic that has been subject to discussions in the sector.
The preliminary report presents different regulatory alternatives, considering aspects such as service standardization, review of service baskets, and criteria for charging for new activities. Two alternatives received a better technical evaluation, but the approval of the study does not represent the choice of a definitive solution. This definition will occur after the analysis of the contributions received and the consolidation of the AIR.
As rapporteur of the process, Director-General Frederico Dias highlighted that the objective of the initiative is to provide greater clarity to the rules, preserving the commercial freedom of the terminals. "What is proposed is to clarify the content of the services, and not to fix their value," he stated.
The Director-General also emphasized that the preliminary analysis does not foresee price fixing. The formation of values remains subject to the commercial freedom of the terminals, observing the duties of transparency and non-discrimination, in addition to regulatory mechanisms for controlling potential abuses.
Sector Participation
The Public Consultation Notice SRG No. 06/2026 will be published in the Official Gazette of the Union (DOU) next Monday (26). Companies, representative entities, and other interested parties may submit information, data, and suggestions on the diagnosis of the regulatory problem and the alternatives under evaluation, exclusively through an electronic form, until 11:59 PM on December 2. ANTAQ will also hold a webinar on November 10 to present the study and clarify the main points under discussion. Information on participation in the public consultation and the event will be disclosed through the Agency's official channels.
