The Executive Power approved the regulations for the cabotage promotion mechanisms provided in Law N.° 32049, with the aim of encouraging innovation, cargo consolidation, and the development of logistical and technological infrastructure linked to commercial maritime transport between ports in the country.
The measure was formalized through Supreme Decree N.° 014-2026-MTC, published in the Legal Norms bulletin of the Official Gazette El Peruano, and regulates the provisions incorporated into the regulations that promote and facilitate maritime transport in cabotage traffic for passengers and cargo.
According to the norm, the main promotional instrument will be the so-called Supervised Innovation Programs, temporary mechanisms that will allow companies, public entities, and other interested parties to develop innovative projects under an exceptional regulatory regime.
The regulations establish that these programs seek to promote new solutions for cargo consolidation and the development of logistical and technological infrastructure, taking into account criteria of innovation, consumer protection, regulatory efficiency, and promotion of free competition.
To this end, the possibility of applying temporary regulatory exceptions or flexibilities, as well as the exemption from certain permits, authorizations, or requirements related to the operation of commercial maritime cargo transport services in cabotage and the use of related logistical infrastructure, is contemplated.
The norm also provides for the creation of a Technical Evaluation Committee, composed of five members, responsible for evaluating innovative proposals, recommending their approval or denial, supervising their implementation, and proposing regulatory improvements derived from the results obtained.
Likewise, it is established that the committee must issue at least one annual call for innovation proposals. These may be submitted by natural or legal persons, national or foreign, provided they are aimed at promoting commercial maritime cargo transport through new or improved products, services, or processes.
Approved initiatives may operate for a period of one to five years, during which they will be subject to monitoring and supervision by the Ministry of Transport and Communications (MTC). Exceptionally, they may receive an extension of up to one additional year.
The regulations also establish mechanisms to suspend or cancel programs when risks to the population, the environment, or free competition are detected, as well as obligations to submit periodic reports on progress and results.
Finally, the norm foresees that those initiatives that demonstrate favorable results may continue operating through a "regulatory conformity" while the corresponding definitive regulations are developed. The MTC must create and form the Technical Evaluation Committee within a maximum period of 30 calendar days from the entry into force of the regulations.
