Brasília, 04/17/2025 - The National Waterway Transportation Agency (ANTAQ) created a new mechanism that can guarantee more investments in Brazilian public ports, called a supported proposal, and changed some extraordinary review procedures.
At the last board meeting, the collegiate approved changes to Resolution 85/2022, which regulates the Extraordinary Review of concession contracts for port administrations, and Resolution 61/2021, which deals with the Supported Proposal mechanism.
These improvements are foreseen in Topic 3.10 of ANTAQ's 2022/2024 Regulatory Agenda. The introduction of the supported proposal mechanism is innovative within ANTAQ and exclusively aimed at port authorities operating under a concession regime.
The reporting director for the matter, Alber Vasconcelos, explained that the supported proposal is different from the tariff review, already provided for in port regulation. According to him, "we already have a tariff review, including a specific rule for it, applicable to organized and delegated ports."
The measure aims to enable investments in leased port terminals, allowing the amounts invested to be compensated through discounts on fees paid to port authorities.
